New Real Estate Rules: What You Need to Know

Today marks a significant shift in the real estate industry as new rules go into effect following the National Association of Realtors (NAR) lawsuit settlement. These changes are set to impact how real estate transactions are conducted, affecting agents, buyers, and sellers alike.

 

Background of the NAR Lawsuit

In May, the NAR settled a series of class-action lawsuits that accused the organization of antitrust practices. The lawsuits claimed that NAR’s compensation rules, which required selling agents to advertise compensation for buyer’s agents on listings, reduced competition and artificially inflated commission prices. As part of the settlement, NAR agreed to implement industry-wide changes and pay over $400 million in damages.

 

Key Changes Effective Today

Buyer Representation Agreements: Starting today, buyers must sign a contract with an agent before that agent can show them any properties. While some states already had this requirement, it is now mandatory for all NAR members, which includes approximately 1.5 million agents across the country.

Agent Commissions: The new rules also change how agent commissions are handled. Previously, sellers often covered the costs of both their agent and the buyer’s agent. Now, this practice is no longer automatic, and buyers may need to negotiate and cover their agent’s fees directly.  However, many sellers will continue to choose to cover the buyer's agent fees.

Transparency in Listings: The settlement prohibits the publication of compensation offers on Multiple Listing Services (MLS), which were previously required to be disclosed.  Buyer's agents will have to contact the seller's agent to determine if the seller will be covering the buyer's agent's fees and if so, how much they will cover.  The buyer's agent can then inform their buyer so the buyer will know this.

 

Implications for the Real Estate Market

These changes are expected to have an impact on the real estate market over time, however it isn't clear exactly what this will be.

For Buyers: Buyers will need to be more proactive in understanding and negotiating their agent’s fees. And make sure to carefully read the buyer representation agreement that the agent is asking you to sign as it will state if you are going to be obligated to pay the agent commission.

For Sellers: Sellers may begin to list their properties without agreeing to cover the buyer’s agent fees.  Implications of this should be carefully discussed with your listing agent.  If sellers do not agree to pay the buyer's agent commission, the buyer may have to pay for it which may make the home less attractive.
